In Hawaii, all assaults are charged by the degree of injury or harm allegedly caused to another person. Assault First Degree, for example, is intentionally or knowingly causing serious bodily injury, and if convicted is a Class B felony carrying up to 10 years. Assault Second degree entails intentionally knowingly or recklesslessly causing substantial bodily harm. It’s a class C felony carrying up to 5 years. The Assault of Law Enforcement Office can be a felony (class C five years prison) or misdemeanor up to one year. But both charges carry MANDATORY minimum sentences in Hawaii state court of “not less than 30 days” if convicted.
